Terms & Conditions

These Terms are a binding agreement between you and Fractiliti Private Limited, a company registered in Mumbai, Maharashtra, India (“Moodshelf”, “we”, “us”). They govern your use of the Moodshelf web app at moodshelf.com, the Moodshelf browser extension, and any related services (together, the “Service”).

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy.

You must be at least 18 years old to use Moodshelf. By using the Service you confirm that you meet this requirement and have the legal capacity to enter into these Terms.

You are responsible for the security of your account — for keeping your login credentials confidential, for revoking API tokens and connected devices you no longer recognise, and for all activity that happens under your account. Tell us promptly if you believe your account has been compromised.

You keep all rights to the content you save, create, or upload to Moodshelf (“Your Content”). You grant us a non-exclusive, worldwide, royalty-free licence to store, display, and process Your Content for the purpose of providing the Service to you — for example, to render your shelves, generate search results, and show shelves you choose to publish.

That licence is limited to running the Service for you, and we want to be specific about one thing it does not include: we do not use Your Content to train artificial intelligence models, our own or anyone else’s. Moodshelf sends parts of Your Content to the AI providers listed in our Privacy Policy so that features like search, moods, and your taste portrait work. Those providers process it to return a result to you and are contractually barred from training on it. We do not sell Your Content, license it to third parties, or use one person’s library to build features for anyone else.

You are responsible for Your Content. You represent that you have the right to save, upload, and publish it, and that doing so does not infringe the rights of any third party.

Shelves are private by default. If you choose to publish one, you make it visible to anyone with the link, and you grant other users a licence to view and share that link for as long as the shelf stays published. You keep ownership throughout.

A published shelf may appear in Explore, in editorial selections, or in other places on Moodshelf where we feature public shelves. You grant us permission to display it that way while it is published, including a title, cover images, and a short excerpt.

You can unpublish a shelf at any time, and deleting your account unpublishes everything. Once unpublished, a shelf stops being served to other people. Copies that already exist outside Moodshelf, such as a search engine’s cache, someone’s screenshot, or a link shared elsewhere, are beyond our control and may persist.

You agree not to use the Service to:

• Upload, publish, or transmit content that is unlawful, defamatory, obscene, hateful, or infringing.
• Harass, abuse, or harm other users, or impersonate anyone.
• Reverse engineer, scrape, or circumvent the Service’s rate limits, authentication, or access controls.
• Use the Service to distribute malware, spam, or phishing content.
• Violate any applicable Indian or local law.

We may suspend or terminate accounts that violate these rules, with or without prior notice.

Moodshelf is a place to keep things you find. Saving a page stores a copy of parts of it, such as its text and images, so your library still works when the original moves or disappears. A private save is for you alone. A shelf you publish makes what is on it visible to others.

We respect copyright, and we act on valid complaints. If you own rights to material that is being displayed publicly on Moodshelf without permission, email hello@moodshelf.com with the subject line “Copyright”. Please include:

• Enough detail to identify the work you say is infringed.
• The Moodshelf link or links where it appears, so we can find it.
• Your name, address, and email, and a way to verify you hold the rights or act for whoever does.
• A statement that you believe in good faith the use is not authorised by the rights holder or the law, and that the information you have given is accurate.

We acknowledge complaints within 24 hours and aim to resolve them within 15 days, as required of intermediaries under Indian law. Where a complaint is valid we will remove or restrict access to the material, and we will tell the user whose shelf it was on unless the law prevents us. If you believe your material was removed in error, reply to us and we will review it. We may suspend accounts that repeatedly infringe.

Notices about defamatory, unlawful, or personal content that is not a copyright matter can go to the same address and are handled the same way.

Moodshelf Plus is billed through our payment processor, Polar.sh, in the currency and on the interval shown at checkout. Subscriptions renew automatically at the start of each billing period until you cancel. You can cancel at any time from Settings; cancellation takes effect at the end of the current billing period and you retain Plus features until then.

We do not offer refunds for partial periods except where required by applicable law. If you believe you have been billed in error, contact us at hello@moodshelf.com.

We may change pricing or introduce new plans with at least 30 days’ notice before the change applies to your subscription.

The Service depends on third-party providers for hosting, storage, payments, email, and AI. Every one of them is named, with what it receives and why, in our Privacy Policy, which is the authoritative list. These providers have their own terms and privacy practices. We are not responsible for the acts or omissions of third parties outside our reasonable control.

Your library is yours and you can have a copy of it. Email hello@moodshelf.com from the address on your account with the subject line “Export”, and we will send you your saves, shelves, notes, and profile in a machine-readable format. There is no charge, and you do not have to say why.

We handle these by hand today, so allow a few days. If you are asking in order to leave, the export still comes; we would rather you go with your library than stay because it is stuck here.

You can delete your account at any time from Settings. We may suspend or terminate your account if you materially breach these Terms, if required by law, or if we discontinue the Service. On termination, the licences you grant us end except to the extent needed to complete outstanding operations (for example, processing a final payment) or to comply with law.

If we ever shut Moodshelf down, we will give you at least 60 days’ notice by email before the Service stops, and export requests stay open for the whole of that period. We will not delete your saves at short notice because the company changed its plans. This does not apply to an account we terminate for breach of these Terms, and it does not apply to circumstances genuinely outside our control.

Asking someone to keep years of their reading in one place is asking for trust, and an exit is part of what makes that reasonable.

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or uninterrupted availability. We do our best to keep the Service running but do not guarantee a specific uptime.

To the maximum extent permitted by law, Fractiliti Private Limited and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Service. Our aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) INR 1,000.

You agree to indemnify and hold Fractiliti Private Limited harmless from any third-party claim, damage, or expense (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Service.

We may update these Terms from time to time. The “last updated” date at the top reflects the most recent revision. If we make material changes, we will notify you by email or in-product notice before they take effect. Continuing to use the Service after the effective date means you accept the revised Terms.

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or the Service will be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra, India.
